Terms of Use

These conditions govern every use of Clare County Criminal History, including reading a page or submitting a search to an outside tool. Continued use means the visitor accepts all terms below. A person who does not agree must stop using the site.

NO FCRA USE. Clare County Criminal History is privately operated and has no government affiliation. The site and its advertising partners do not provide consumer reports for credit, employment, tenant screening, insurance, or another purpose governed by the Fair Credit Reporting Act (FCRA). This resource is neither a consumer reporting agency nor a private investigation service.

1. What This Website Is

This private reference site is independent of every government office. It neither stores official records nor retrieves histories, conducts authorized checks, or files documents for a user.

Its role is to identify access channels at Clare County Sheriff, the county courts, MSP CJIC, and Michigan PSOR, and to provide links to optional outside research tools.

2. Rules for Using This Site

Each visitor agrees not to:

  • Use bots, scrapers, or other automated means against the pages
  • Interfere with service or prevent others from accessing it
  • Attempt unauthorized entry into any system or account
  • Use site information to threaten, stalk, or harass a person
  • Make a credit, employment, housing, or insurance decision from site content
  • Violate applicable federal, Michigan, or local law

3. No Harassment, Stalking, or Discrimination

No site or linked-tool information may be used to stalk, intimidate, threaten, harass, or unlawfully discriminate against anyone. Michigan PSOR exists for safety awareness, not vigilante action. MCL 28.734 provides criminal and civil consequences for threatening, intimidating, or harassing a registrant or another person at a reported address.

4. We Are Not a Consumer Reporting Agency

The site is not a consumer reporting agency under the FCRA and produces no credit report, consumer report, or official background check. Its content and linked-tool results may not be used to:

  • Set insurance terms or assess creditworthiness
  • Evaluate employment or continued employment
  • Review a rental or housing application
  • Determine eligibility for a regulated license, benefit, or program
  • Carry out any other FCRA-regulated purpose

A regulated purpose requires the proper official process or a screening provider that complies with the FCRA.

5. No Legal Advice

General explanations about Clare County records are not legal advice. Only a licensed Michigan attorney can advise how a charge, conviction, warrant, or set-aside rule applies to particular facts.

6. No Warranties

All content and services are offered "as is," without a guarantee that:

  • An outside search result will be accurate or complete
  • The pages contain no error, bug, or security weakness
  • The service will remain uninterrupted or available
  • Any information is complete, accurate, or current

Charges, dismissals, corrections, and set-aside orders can change a record. Gaps and delays are possible, and no statement here should be treated as an official position of Clare County Sheriff, a court, or another agency.

7. Third-Party Services and Links

Links may lead to sheriff, court, state agency, legal-service, and commercial search sites. Those services control their availability, data practices, prices, and content. Their terms should be reviewed before use because this site is not responsible for them.

8. Intellectual Property

Clare County Criminal History or its content partners own the site's text, graphics, logos, and code. Written permission is required to copy, adapt, distribute, or create derivative material.

9. Limits on Our Liability

To the greatest extent allowed by law, the operator is not liable for loss or damage arising from site use, linked services, or reliance on information obtained through either.

10. Indemnification

A visitor agrees to indemnify and hold the operator harmless from claims, demands, or proceedings caused by that visitor's use or breach of these terms, including related legal costs.

11. Governing Law

Michigan law governs these terms. Any dispute arising from use of the site must be brought in a court located in Michigan. Government-record access remains governed, where applicable, by Michigan Freedom of Information Act, MCL 15.231 et seq., and public criminal-history dissemination by MCL 28.242a.

12. Changes to These Terms

The terms may be revised at any time. A revision becomes effective when the updated text is posted to this page.

13. Cutting Off Access

The operator may restrict or end access at any time, for any reason, and without advance notice.

14. Severability

If one provision is held invalid or unenforceable, all remaining provisions continue in effect. The affected language will be limited only as much as needed to make it enforceable.
