Access Clare County Criminal History

People who check Clare County criminal history must match the question to the office that holds the source record. Michigan court clerks keep filed charges and outcomes, while the sheriff keeps its incident reports and county booking material. The state repository offers a public name search, but that result is only one part of the record. A sound Clare County record search may also require a call, a written request, or a certified court copy. These official paths help readers review their own records, trace a case, confirm custody, or understand how local justice records fit together.

Clare County Criminal History Checks

Begin with the record that can answer the question. MiCOURT is the first online stop for a filed misdemeanor or felony case. The 80th District Court holds misdemeanors, arraignments, and the early part of a felony. After bindover, the 55th Circuit Court holds the felony trial, plea, disposition, and sentence. The Clare County Sheriff and Jail handle sheriff reports and county custody records. ICHAT, run by the Michigan State Police Criminal Justice Information Center, compiles the public part of reportable Michigan history.

Names alone can produce a poor match. Gather a full legal name, former names, a date of birth, the incident location, and any case or report number. Then work from the broad index to the source file:

  1. Search MiCOURT by the Clare court and case number when one is known; otherwise use the party name and available date fields.
  2. Call the District Court at (989) 539-7173 or the County Clerk at (989) 539-7131 when a file is old, absent, or split across court levels.
  3. Use ICHAT for the public statewide Michigan compilation, entering every required identity field with care.
  4. Call Clare Jail at (989) 539-7166 for current county custody, since no verified public web roster was found.
  5. Order the report, register of actions, judgment, or certified copy from the agency that created or keeps it.

A result from one step does not cancel the need for another. A booking record shows intake. A court file shows what prosecutors filed and what the judge decided. A state history joins reported events by identity.

Two Clare County Record Counters

Clare County makes the line between police and court records unusually easy to picture. The courthouse at 225 W. Main Street in Harrison holds District Court, Circuit Court, the County Clerk/Register of Deeds, and the Prosecutor. The sheriff and jail sit next door at 255 W. Main Street. A reader can be within one block of both records and still be at the wrong counter.

Ask the courthouse for the register, filed pleadings, disposition, sentence, and certified judicial copies. Ask the sheriff for a sheriff incident narrative, county booking fields, fingerprint service, or a FOIA route. ADA coordination is available through the District Court, but current entry rules should be confirmed before a visit.

Official Background Checks in Michigan

The Michigan State Police criminal-history program offers two different self-review paths. ICHAT is a $10 name-based search of public Michigan criminal-history information. It can show reportable felony arrests and convictions, serious-misdemeanor convictions, and pending reportable cases. It omits warrants, juvenile and traffic matters, suppressed records, local non-reportable misdemeanors, and federal, tribal, out-of-state records.

The MSP fingerprint personal-record review costs $30. A person submits an RI-008 or FD-258 fingerprint card, a cover letter, and payment to CJIC. MSP says the response goes only to the fingerprinted person and generally takes three to five weeks. The Clare County Sheriff offers Live Scan for authorized electronic checks at its Harrison office on typical weekdays from 8:30 a.m. to 3:30 p.m. Call extension 4220 first because availability and capture fees vary.

Clare County ICHAT Record Limits

ICHAT asks for first name, last name, date of birth, race, and sex. Each alias or maiden name may need its own paid search. Care with those fields matters because the product is name-based, not fingerprint-confirmed. Searchers should save or print the response during the portal’s availability window and compare it with the Clare County court file.

If a disposition is missing or wrong, send the correction to the source. The arresting agency corrects its arrest segment, the prosecutor addresses its charge report, and the court corrects judicial data. MSP CJIC can process an agency update, but it cannot decide what a Clare County judgment should say.

The MSP record review and correction instructions explain that route.

This official correction path is more reliable than trying to fix an error through a secondary copy of the record.

Kinds of Criminal Records

Clare County records are created at different points. The responding agency writes the incident report. Clare Jail creates the booking file. The prosecutor files or changes charges, and the clerk records hearings and the result. MSP links reportable arrest cycles with later disposition data. No one record replaces all the others.

  • Incident and arrest report: the agency narrative, time, place, alleged offense, and investigation details, subject to FOIA exemptions.
  • Booking record: jail intake, charges received, bond, custody, and release fields, not proof of guilt.
  • Court file: complaint, information after bindover, hearings, motions, disposition, sentence, and financial ledger.
  • State history: person-centered reportable cycles assembled by MSP, with important public exclusions.
  • Custody or supervision record: Clare Jail for local custody and MDOC OTIS for qualifying prison, parole, or felony-probation status.

Warrants are separate. ICHAT expressly excludes them. MiCOURT may show a warrant event, but neither source is a real-time warrant confirmation tool.

Clare County Custody Record Paths

No verified public Clare County jail roster or active-warrant database was exposed in the official sources. For recent custody, call the jail control room or front office. For a copy of booking fields, submit the county FOIA form to sheriff records. A person who has been released, transferred, or booked elsewhere may not be found by a current custody call.

OTIS serves a different population. It can show MDOC prison, parole, and felony-probation information, but MDOC says it excludes county-jail-only prisoners, unsentenced people, and those discharged from supervision beyond its display window. Michigan VINE provides custody-status notifications. The federal Bureau of Prisons locator covers federal sentences, not Clare Jail or an MDOC facility.

The official Bureau of Prisons locator is therefore a narrow federal fallback. For local arrest layers, use the dedicated Clare County arrest search routes and keep the jail, court, and state systems distinct.

Clare County Criminal Records: What They Contain

A Michigan criminal-history record begins with identity descriptors, then groups reportable events into arrest cycles. A cycle may list an arrest date, submitting agency, arrest charge, prosecutor action, court disposition, and sentence. Public ICHAT suppresses nonpublic identifiers and excluded categories. The source file may contain more detail.

Name and identifiersLegal and prior names, birth data, physical descriptors, marks, and state or transaction identifiers where public.
Arrest and bookingAgency, date, intake event, submitted charges, booking number, bond, and release data where released.
Charges and statutesAlleged offense at arrest, filed complaint or information, and statutory citations that may change during the case.
DispositionDismissal, acquittal, plea, conviction, or other charge result reported by the court.
SentenceCustody, probation, fines, restitution, or other terms imposed after conviction.
Supervision statusPublic MDOC status when OTIS coverage applies; local jail or court sources for other cases.

A difference between records is not always an error. Booking charges can be amended or declined. A felony may have a District Court number and a later Circuit Court number. Reporting lags can also leave a state cycle without the newest court outcome.

Clare County Criminal Record FOIA

The Clare County Sheriff routes crash reports to BuyCrash and other sheriff records through the county FOIA process. A written request should describe existing records with an incident or case number, date range, place, agency, and the exact item sought. The county form supports inspection, copies, certified copies, mail, email, pickup, and other stated delivery choices. Sheriff-specific requests may be emailed to vanwagnerl@clareco.net.

Under MCL 15.235, a public body generally responds within five business days by granting, denying, granting in part, issuing a permissible extension, or requiring a deposit. That response deadline is not a promise that a complex request will be finished in five days. MCL 15.234 allows itemized labor, copying, and mailing charges within the statute. Ask for an estimate and electronic delivery when it fits.

Juvenile material, protected victim information, LEIN data, personal identifiers, and active investigative detail may be withheld or redacted. Court case files follow judicial access rules rather than the ordinary county FOIA route. Use the clerk for the judicial record.

Michigan Public Access Laws

Michigan separates executive-agency records from court records. FOIA governs requests to county and police bodies, while court rules and administrative standards govern public case files. The MSP dissemination law controls the public state criminal-history product. These rules allow access, but they do not turn sealed, juvenile, or protected information into public material.

Key statutes:

MCL 15.231 states Michigan's policy of access to public-body records under FOIA.

MCL 15.233 provides inspection and copying rights and request mechanics.

MCL 15.234 governs itemized FOIA fees, deposits, and waivers.

MCL 15.235 sets the response, extension, denial, and appeal-notice framework.

MCL 28.242a governs MSP dissemination of public criminal-history information.

Arrest and booking data do not prove guilt. Registry information also carries a distinct statutory ban on threats, intimidation, and harassment.

Three Clare County Record Answers

MiCOURT, ICHAT, and OTIS answer different questions. MiCOURT is case-centered. It can show a court, case number, status, filing dates, party role, charges, events, and a register of actions when the participating court publishes them. A docket may be public even when document images are not online. Older records may also fall outside online filters, so the clerk remains the archive fallback.

ICHAT is person-centered and statewide, but only for reportable public Michigan history. OTIS is corrections-centered and does not include county-jail-only custody. Readers tracing one Clare County event should compare the three without treating an empty result as proof that no record exists.

Register of actions
The chronological court docket listing filings, events, and orders.
Bindover
The transfer of a felony from District Court to Circuit Court after waiver or a probable-cause finding.
Disposition
The result of a charge or case, such as dismissal, plea, verdict, or conviction.
OTIS
The MDOC public locator for covered prison and supervision records, not the Clare County jail roster.

Restricted, Sealed & Expunged Records

Juvenile matters, sealed files, protected personal data, and set-aside convictions do not appear like ordinary public Clare County criminal records. ICHAT excludes juvenile and suppressed material. A set-aside makes an eligible conviction nonpublic through ordinary search, but authorized government uses may remain. It does not mean that every government trace was destroyed.

Michigan offers application-based set-aside relief under MCL 780.621 and automatic Clean Slate relief under MCL 780.621g. Eligibility turns on the conviction type, count, exclusions, waiting period, and later conduct. An application may require the proper court form, certified judgment or register, fingerprints, service on named agencies, and the $50 MSP processing package. Use current court and MSP instructions instead of relying on a broad eligibility summary.

The MSP set-aside instructions list the state processing materials.

Clare County City Record Routing

The City of Clare crosses the Clare and Isabella county line. That fact can change which jail and trial court hold an event. Start with the incident location, not merely the mailing address or the city name. A Clare Police report remains with the city police and its FOIA channel, while the county of occurrence controls the county booking and trial-court route.

The official City of Clare site provides the local government starting point.

For a Clare County-side event, the path runs from Clare Police to Clare Jail and the Harrison courts. Isabella-side events may belong to different county offices. The Clare record check explains that city-specific split.

City-by-City Criminal Records in Clare County

The county's three largest incorporated places use different local routes. Clare has its own police department and crosses a county line. Harrison is the county seat and relies on the county sheriff for policing and booking. Farwell is an incorporated village; a search must identify whether the sheriff, MSP, or another agency responded. None has a separate felony court.

Clare County Record Access Context

Clare County covered 564.37 square miles and had 30,856 residents in the 2020 census. The Census Bureau estimated 31,543 residents in 2025. About 27.5 percent of residents were age 65 or older in the latest QuickFacts display. Those facts make phone, mail, and counter fallbacks especially useful when no public county jail roster is available.

The court system also has a regional wrinkle. The 55th Circuit Court serves Clare and Gladwin Counties, yet a Clare filing remains with the Clare County Clerk in Harrison. Court pages can name shared judges without changing the correct local filing counter.
